Conditions of sale

saSafari, whose registered office is located at 2, rue Adolphe Lalyre, 92400 Courbevoie, France, is the holder of the state licence IM092110056 and a member of the A.P.S.T (Association Professionnelle des Agences de voyages), which provides its financial guarantee.
saSafari has taken out insurance to cover the consequences of its professional civil liability with HISCOX, 12 quai des Queyries 33100 Bordeaux, for a guarantee amount for all damages (bodily injury, material and immaterial, whether consequential or not) of 1,500,000 euros.
We inform you that the services in your travel programme constitute, in the sense of the regulations, a package and that, as such, you benefit from the rights specified in article 14 of the present conditions of sale.

1. Registration
Registration for one of our trips implies adherence to the conditions set out below, of which the customer acknowledges having taken cognizance.

1.1. You agree to carry out the trip, as detailed in your travel programme, by your registration. This is done by signing your travel contract, saSafari's conditions of sale and by paying saSafari the price of the trip according to the terms and conditions specified in articles 2.1 and 2.2 below.
Each signatory of a contract is personally committed for the persons registered on the same file. The registration is materialized by a contract signed by the parties that mentions the services concerned and, if applicable, indicates the services whose availability is not certain.

1.2 Down payment : All registrations must be accompanied by a deposit of 50% of the total amount of the chosen trip in order to be confirmed. The balance must be paid 60 days before departure. For registrations made less than 60 days before departure, full payment of the price of the trip will be required at the time of registration.

1.3 For any payment the amount of which is validated and cashed by saSafari, an invoice will be sent to the person who made the registration on behalf of the traveller(s) of the travel programme. Any delay in the payment of the balance will be considered as a cancellation by you, for which the cancellation fees referred to in Article 5 below will be applied. In accordance with article L 221-28 of the French Consumer Code, you do not benefit from a withdrawal period for the purchase of travel services. Your registration is definitive as soon as you sign your travel contract.

2. Prices
The prices include the amount of the services and our technical organization costs. No dispute concerning the price of the trip can be taken into account on the return journey. It is up to the customer to assess before his departure whether the price suits him, accepting at the same time that it is a fixed price including a whole series of services, the prices of which cannot be detailed by saSafari. The customer must have paid the full price of the trip 60 days before departure (date of receipt by saSafari).
2.1 Terms of payment
- In case of registration more than 60 days before departure: 50% deposit at the time of registration for the trip, then the balance, i.e. 50% 60 days before departure.
- In case of registration less than 60 days before departure: 100% payment.
- In the absence of payment within the above period, saSafari may be led to consider that the contract has been terminated by the customer and shall be entitled to retain a sum corresponding to the cancellation indemnity provided for in Article 5 below.
- The amount of the insurance premiums subscribed by the client on the occasion of his trip is paid upon registration with the receipt of the deposit or any other sum paid by the client upon signing the registration form.
2.2. You can pay the price of your trip (Deposit, balance of the price or total price for any registration) less than 60 days before the departure date):
Payment method is by bank transfer to saSafari, accompanied by the signed travel contract and the general and special terms and conditions of sale, also signed.
2.3. As soon as you have paid the deposit or the total price of your trip, if applicable, saSafari will send you an invoice within 8 days. The balance of the price of your trip must be paid, without any reminder on our part, at the latest 60 days before the departure date. Any delay in the payment of the balance may be considered as a cancellation for which the cancellation fees referred to in article 5 below will be applied.
In accordance with Article L 221-28 of the French Consumer Code, you do not benefit from a withdrawal period for the purchase of travel services. Your registration is definitive as soon as you have signed your travel programme.
2.4. 2.4. Currency exchange rate fluctuations: If currency exchange rate fluctuations affect the total price of the trip by more than 3%, this impact will be passed on in full, both upwards and downwards.
3. Travel Informations

3.1 Administrative and health formalities
Before registering to undertake your trip, you must check that each traveller, depending on their personal situation and nationality, is in possession of the valid passport or national identity card (CNI) that will be used for the planned trip, as well as any other document(s) (visa / ESTA authorisation, family record book, authorisation to leave the territory...) that are necessary and comply with the requirements for transiting and/or entering the country(ies) of travel.
SaSafari delivers this information for all French nationals. For the other nationalities, we are at your disposal to guide you through the steps. It is the responsibility of each traveller to check that their documents, particularly administrative and health documents, required for the completion of the trip, are in conformity with the information provided by SaSafari, it being specified that it is the responsibility of the person who has registered for the travel contract to relay the information relating to the formalities to each of the travellers registered for the trip.
It is strongly recommended that the customer verify all information with the relevant authorities. SaSafari cannot, under any circumstances, be held responsible for the consequences of the customer's failure to comply with police, customs or health regulations before and during the trip.
A customer who is unable to board a flight due to failure to present the required documents mentioned on the sales contract given to him/her, cannot claim any reimbursement.

3.2 Information on safety and health risks
SaSafari advises you to consult the country sheet(s) of your trip (destination country and countries crossed) available on the website of the Ministry of Europe and Foreign Affairs (MEAE), under the heading "Travel advice / Advice by country".
saSafari draws your attention to the fact that the information may change up to the date of your departure, so you are advised to consult it regularly.
Health risks: We invite you to regularly consult the information disseminated by the competent authorities on the health risks of the country/countries of your trip and to follow the recommendations and health measures to combat these risks available on the sites (French Ministry of Solidarity and Health), (World Health Organization).

3.3 Accessibility
Our tailor-made trips allow us to envisage services adapted to your personal situation, especially if you have constraints to move around and/or carry out any activities inherent to a leisure trip (transport, accommodation, excursions...). At the time of briefing us on your travel project, we invite you to inform us of any restrictions and/or particularities for each traveller to enable us to offer you services adapted and accessible in case of reduced mobility. If your request includes transport services, particularly air transport, it is the responsibility of the traveller concerned to notify us in advance in order to organise the necessary assistance for transport, particularly air transport, both in the airport and in the air.

3.4 Transmission of information
The person registering in the name and on behalf of all participants in the trip undertakes to transmit to each traveller the information provided by saSafari concerning the trip so that saSafari cannot be held liable for any defect or omission in the transmission of this information.

4. Changes/Interruptions to services requested by the traveller(s)
4.1. Transport services
After registration for the trip, any change to the transport and in particular to the name(s) of the traveller(s) may result in additional costs and/or penalties, the amount of which must be paid by the traveller(s) to saSafari by any means prior to departure. In the absence of payment, saSafari shall not be obliged to make the desired changes.

4.2. Other services
After registration for the trip and before the departure date, any request for modification (additions or withdrawals, extension, delayed return, change of accommodation.) of travel services can only be made with the prior agreement of saSafari and the payment to saSafari of the costs incurred, by any means of payment that allows collection. In the absence of collection, saSafari cannot be obliged to make the desired changes.
From the date of departure, any request for modification and/or request for non-performance of all or part of the travel services will not give rise to any reimbursement of the initial services. Any new service requested during the trip must be paid for in advance with saSafari or the designated service providers.

4.3. Special cases
Any request for a change in the departure and/or return date may give rise to the invoicing of additional costs. Failure to pay the modification fees will be considered as a cancellation/resolution on the part of the traveller(s) for which the conditions set out in Article 5 will be applied.

5. Cancellation conditions and costs
If the traveller(s) registered on the trip is (are) obliged to cancel their participation in the trip, they must inform their insurer and the person who registered for the trip must inform saSafari by any written means that allows an acknowledgement of receipt, as soon as the event giving rise to the cancellation occurs. The date of issue of the written document will be used as the date of cancellation for the invoicing of the cancellation fees. We draw your attention to the fact that the Insurer, on the basis of the documents communicated directly to it by the insured, will use the date of the event giving rise to the decision to cancel participation in the trip to agree to reimburse the cancellation costs. The insurance premium, registration fees, visa fees (costs of obtaining and price of the visa) are not refundable either by saSafari or by the insurer.
Depending on the services planned for your trip and in order to take into account the constraints imposed by our service providers, in the event of cancellation on your part before departure, we may apply to you either cancellation fees based on our actual justified costs at the date of your cancellation, or the cancellation fee schedule specified in 5.1 and 5.2 below. Unless otherwise specified, the schedule of cancellation fees set out in 5.1 and 5.2 below will apply.

5.1. Schedule of total cancellation fees, except in special cases (5.3)
. More than 60 days before the departure date: 10% of the total amount of the services, with a minimum of 100 € per person.
. Between 60 and 31 days before the date of departure: 30% of the total amount of the services, with a minimum of 200 € per person.
. Between 30 and 21 days before the departure date: 60% of the total amount of the services.
. Between 20 and 14 days before the date of departure: 90% of the total amount of services
. Less than 13 days prior to the departure date: 100% of the total services amount.

A cancellation processing fee will be added to this fee schedule:
- 300 € for a trip of 8 days or less
- 500 € for a trip longer than 8 days

The total amount of the cancellation fees (fees in % + lump sum) cannot exceed the total amount including VAT of the trip.

5.2. Scale of charges for partial cancellation, except in special cases (5.3)
If one or more travellers registered on the same file (Registration Form) cancel(s) their participation in a trip maintained for the other participants, the above scale of cancellation fees will be calculated for the traveller who cancels on:
-The price of the nominal services (plane tickets) and not used yet at the date of the cancellation, and
-The share of the shared benefits of the trip that will be used and shared by other travellers.

5.3. Special case :
Cancellation charges are 100% of the price for all tickets issued from the date of registration.

6. Air Transport
6.1. Airlines
Sasafari will inform you at the time of your registration of the identity of the air carrier(s), known at that date, likely to operate your flights. In the event of a change, after your registration, Sasafari undertakes to inform you of any changes in the identity of the air carrier(s) as soon as it becomes aware of them before your departure.
In accordance with our obligation, we inform you that the European list of banned airlines can be consulted on the website or requested from saSafari.
Boarding fees for tickets not consumed are refunded on request (art. L 224-66 C. consom.).

We would like to point out that :
- Stopover times are determined by the airlines according to their flight plans and can be modified without this constituting a reason for cancellation without charge.
- In the event that the airline company that is to provide your flight is unable to transport you, despite its obligation to provide assistance, saSafari may use another airline company in order to provide you with comparable transport conditions.
- Remote check-in procedures (before going to the airport) to obtain the boarding pass (with or without the choice of cabin seat) can be carried out within the time limits (number of hours before the scheduled flight time) set by each airline according to the flights.

6.2. Conditions of carriage
The airline's general and special conditions of carriage (in particular the number of baggage items permitted and their maximum weight at no extra charge) are available on the airline's website or on request. In accordance with international regulations governing air transport, any airline may be required to modify, without prior notice, in particular the timetable and/or itinerary as well as the airports of departure and destination. If in the event of changes by the airline company, in particular due to technical, climatic or political incidents outside Sasafari, delays or cancellations or strikes outside Sasafari, additional stopovers, change of aircraft, route, political or climatic events, the customer decides to cancel the trip, the customer will be charged the cancellation costs referred to in Article 5 above. saSafari will not reimburse the costs (taxis, hotels, transport, catering...), as long as the customer is under the protection of the airline company. In the event of a delay in transport on departure or return and/or damage or loss of luggage, denied boarding (overbooking) and/or cancellation of the flight by the airline, we recommend that the traveller, in order to enable him/her to assert his/her rights vis-à-vis the airline, keep all original documents (tickets, boarding passes, luggage vouchers, etc.) and request any written proof from the airline in the event of denied boarding (overbooking) or cancellation of flights (hereinafter, the "Proof"). The Traveler shall send the Airline, as soon as possible, given the short deadlines imposed, his/her claim with a copy of the Supporting Documents and shall keep the originals.

6.3. Routing before departure and on return from the journey
If you organise your pre- and post-transport services on our own (transport, hotel, etc.) to the place where the journey begins and to your home on your return home, we recommend that you purchase services (tickets, etc.) that can be modified and/or reimbursed and that you allow reasonable transfer times between airports/train stations. In the event of a case of force majeure, an unforeseeable and insurmountable event by a third party or by the traveller that modifies the services of your trip with saSafari and involves modifications to the above services, saSafari will not reimburse the costs incurred.

7. Insurances
As a member of the Professional Association of Solidarity in Tourism (A.P.S.T), saSafari is able to offer its customers an exclusive and free benefit: The Guarantee of Deposited Funds.
The Guarantee of Deposited Funds gives the Consumer Customer the certainty of completing or continuing his trip, in the event of a possible financial failure of the professional. Since 1997, the Association Professionnelle de Solidarité du Tourisme (APST) has unilaterally removed the ceiling on its reimbursements. The APS guarantee called "Guarantee of Funds Deposited" applies to the entire amount of funds deposited by the "client-consumer".
saSafari offers you 3 different insurance formulas for your trip: a Tourist Convention, a Multi-risk Convention and a Baggage Assistance Convention.
The complete booklet of the general and special conditions of these insurance contracts will be sent to you before you sign the registration form. These contracts contain limitations of cover, exclusions, deductibles and obligations in the event of a claim. We invite you to read them carefully. It is your responsibility before or during your trip to personally contact the insurer in order to activate your insurance contract.

7.1. Procedure for declaring an insurance claim

8 • Minors
Applications for enrolment of minors must be signed by the father, mother or legal guardian and marked "agreement of father, mother or guardian".
Minors who are not travelling with their parents or guardians must be in possession, depending on the destination, in addition to the identity documents (CNI or passport, as the case may be) required for the trip, of a valid authorization to leave French territory. In addition, the documents provided by saSafari will mention a telephone number and address enabling the minor or the adult responsible to establish direct contact.
For minors travelling with one of the parents, guardians or other adults, you should ensure that you are in possession of the documents necessary for the minor accompanying you (national identity card or passport and, where applicable, authorisation to leave the country) to enable him or her to leave the country and/or to establish, in particular if the minor does not have the same surname as the adult accompanying him or her, proof of parental authority (family record book, court decision, etc.).

9. Rates
9.1 Upon signature of the registration form, the price is firm, definitive and in euros. However, in accordance with the law, up to 20 days from the date of departure, we may be obliged to make upward or downward adjustments, if they are not significant, without the possibility of cancellation/resolution without charge on your part, to take into account one or other of the following variations :
- the price of passenger transportation resulting from the cost of fuel or other energy sources.
- the level of taxes or charges on the travel services included in the contract imposed by a third party not directly involved in the performance of the contract, including tourist taxes, landing taxes or embarkation and disembarkation taxes at ports and airports.

9.2. Cancellation for part of the travellers.
If one or more travellers registered on the same file cancel(s), the trip may be maintained as long as the participants have paid, before departure, the possible additional cost of the services that have had to be modified due to the cancellation of the traveller(s). Any refusal on the part of the traveller(s) remaining registered to pay this adjustment will be considered as a cancellation on the part of the traveller(s) concerned, with application of the scale in Article 5.

10. Land-based services
10.1 Unused benefits/changes
Services that are voluntarily modified by the customer on the spot are subject to the conditions of the local service providers: additional or replacement services that generate additional costs must be paid for directly on the spot and may in no case engage the responsibility of saSafari. Services not used on site (transfers, excursions, accommodation, etc.) will not give rise to any reimbursement.

11 • Reassignment of the contract
In accordance with article R.211-7 of the Tourism Code, you have the possibility of reassigning your contract to a transferee who fulfils the same conditions as you to carry out the trip, as long as the package has not produced any effects. You are required to inform saSafari of your decision by any means allowing you to obtain an acknowledgement of receipt and at the latest seven days before the start of the trip.
In the event of reassignment of the contract, the assignor and/or the assignee are first required to pay the costs incurred by the assignment, which will be communicated to you by saSafari.

12. Responsibility
saSafari cannot be held responsible for the consequences of the following events:
- Loss or theft of airline tickets by the traveller(s).
- Failure to present to the authorities and/or carriers (airlines...) the administrative and/or health documents required to undertake the journey and/or enter the country(ies) of travel and/or cross the borders, in accordance with the information provided by saSafari.
- Arrival after the scheduled time at check-in and/or boarding of any transport journey, in particular air transport. No refund of the transport ticket will be owed by saSafari in this case.
-Unforeseeable or unavoidable events of a third party such as: war, political unrest, strikes outside saSafari, riots outside saSafari, technical or administrative incidents outside saSafari, airspace congestion, bad weather, delays (including in mail forwarding services, etc.), breakdowns, loss or theft of baggage or other personal effects of passengers.
- Cancellation imposed by exceptional and unavoidable circumstances, and/or for reasons related to the maintenance of the safety of the travellers, and/or injunction from an administrative authority: in this case, saSafari reserves the right to modify the dates, times or routes planned if it deems that the safety of the traveller cannot be ensured.
In the event that saSafari's liability is called into play due to the actions of the service providers, the compensation limits provided for by international conventions will be applied, in accordance with article L 211-17-IV of the Tourism Code. Except in the case of personal injury, the maximum financial liability of saSafari shall be limited to three times the total price of the trip.

13 • Claims
13.1 During the trip
We invite you to contact saSafari if you notice any non-conformity in the performance of the services of your trip, by dialling our number, the details of which will be given to you on the documents provided by saSafari. In the event of a complaint, your failure to report any non-conformity in the performance of the services during your trip will be taken into account, where applicable, if it could have financial consequences.
13.2 After your trip
Each traveller has the option of lodging a complaint about the conditions of performance of the services of his or her trip in writing to saSafari, 2 rue Adolphe Lalyre, 92400 Courbevoie, as soon as possible after the date of return from the trip, accompanied by supporting documents. If you do not receive a satisfactory response within a maximum of 60 days, you may refer the matter to the Tourism and Travel Mediator, whose contact details are as follows: MTV Médiation Tourisme Voyage - BP 80 303 - 75 823 Paris Cedex 17. 14 • Personal information
The information you send us is recorded in a computerized file by sasafari SARL registered with the Nanterre RCS under the number 531 002 749, whose head office is located at 2 rue Adolphe Lalyre 92400 Courbevoie, in its capacity as data controller. Certain information must be provided to saSafari when you register and/or apply for a travel project. The processing of your personal data is necessary to enable us to offer you a contract for the completion of your trip and to carry it out. The personal information collected is used to enable you to access all information concerning your trip(s) or travel request(s), to execute your requests (travel project, provision of travel services), to offer you similar services or trips likely to be of interest to you, to produce statistics, to communicate to you with your consent information relating to saSafari and its partners (news, products and services, commercial prospecting and personalised offers). We would like to inform you that in order to enable the execution of your order for travel services, your data will be communicated to the subsidiaries and partners of saSafari, suppliers of reserved services (hoteliers, carriers, etc.) or to technical service providers, which may be located outside the European Union. Our partners undertake to use your personal data only to carry out certain tasks that are essential to the completion of your trip, in strict compliance with your rights in terms of personal data protection and in accordance with the legislation in force. saSafari undertakes not to transfer or sell your personal data to third parties that are not partners.
Your data is kept for the duration of our contractual relationship and for the duration necessary to meet a legal or regulatory obligation. In any event, if you do not make contact with us for a period of five years, your personal data will be archived for a further five years before being permanently deleted or made anonymous.
In accordance with the French Data Protection Act No. 78-17 of 6 January 1978 as amended, you have the right to access, oppose (including the sending of marketing communications), rectify, limit and delete as well as the right to portability of your personal data. You also have the right to define guidelines regarding the fate of your personal data after your death. 15 • Traveller's rights
The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the Tourism Code. You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code. saSafari will be entirely responsible for the proper execution of the package as a whole.
In addition, as required by law, saSafari has protection to refund your payments and, if transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.
